Our commitment to our users

The use of Groupe Mutuel’s platforms is governed by the General Terms and Conditions of Use and the Privacy Policy. For the sake of transparency and security, we recommend that you read these charters and review their contents.

  1. Purpose
    These General Terms and Conditions of Use (CGU) refer to the website www.groupemutuel.ch, as well as to all the platforms of Groupe Mutuel Services SA, Rue des Cèdres 5, 1919 Martigny, Switzerland (Groupe Mutuel), including GMnet and GMapp and the premium calculator. The protection of your personal data processed in relation to the platforms is governed by the Privacy Policy.

     
  2. Gender
    For the sake of readability, only the masculine gender is used in the different platforms. However, it refers to both men and women.

     
  3. Copyright and intellectual property
    The contents of Groupe Mutuel’s platforms are the intellectual property of Groupe Mutuel. They are protected by copyright and other intellectual property laws and agreements, subject to the rights of third parties. You must comply with these rights and you are not authorised to reproduce, transmit, publish or otherwise transfer, in whole or in part, the contents of Groupe Mutuel’s platforms, to modify or to use them for any public or commercial purpose, unless expressly indicated or provided for by the features of Groupe Mutuel's platforms. You are not allowed to breach any intellectual property rights, copyrights or other proprietary rights. You are not granted any rights, in particular with regard to company names, commercial protection rights such as patents, usage models or trademarks. Groupe Mutuel declines any obligation to grant such rights.

    Therefore, you are allowed to share certain contents of Groupe Mutuel’s platforms via social networks such as Facebook, Twitter or LinkedIn, or via email, as long as the platforms of Groupe Mutuel contain dedicated buttons for this purpose (“social plug-ins”). Groupe Mutuel suggests that you check the Privacy Policy regarding data protection issues related to these features.

    If you leave ideas or suggestions on the platforms, Groupe Mutuel has the right to use them free of charge for the development, improvement and sale of the products in its portfolio. Any suggestions or ideas will become the property of Groupe Mutuel.

     
  4. Obligations of the user
    When using Groupe Mutuel’s platforms, you are not allowed to:
    - offend public decency by the way you use the platforms;
    - transmit any contents containing viruses (Trojan Horses) or any other programme that may damage software;
    - introduce, save or send hyperlinks or objects for which you have no authorisation, in particular if these hyperlinks or objects violate privacy rights or are illegal; 
    - distribute unsolicited advertisements or emails ("spam") or irrelevant virus alerts, or to participate in gambling, snowball systems, chain letters, pyramids or any other similar action.
    - Groupe Mutuel reserves the right to block access to its platforms at any time, in particular if you breach your obligations under these terms and conditions.

     
  5. Responsibility of the user
    As a user, you are responsible for your technical access to the platforms. Groupe Mutuel assumes no responsibility for the IT provider or for the hardware and software required to use the platforms.

    Although Groupe Mutuel will take the necessary technical and organisational measures to secure the data made available to you, insufficient security measures on your devices may result in unauthorised access to your data. It is not excluded that a third party may access your devices without being identified when you connect to the platforms. Groupe Mutuel therefore recommends that you equip your devices with up-to-date protection software and protect them with a password when using a WLAN. It is also not recommended to identify yourself on the platforms via a public WLAN. The end device (computer, telephone, mobile, etc.) and/or the network you use are outside the control of Groupe Mutuel and may constitute a weak point. As a user, you accept the related risks. It is your responsibility to find out exactly what safety devices are required, which should be up to date, and to take the appropriate protection measures.

    The login, password and authentication code used to connect to the platforms must be kept secret and protected against misuse by unauthorised persons. Although Groupe Mutuel takes appropriate organisational and technical measures in accordance with the law to protect your data from unauthorised handling, you are responsible for all consequences resulting from the misuse of its authentication keys by unauthorised persons, except in the event of gross negligence on the part of Groupe Mutuel. If there is reason to assume that unauthorised third parties are familiar with these authentication keys, you must change them immediately.

    When you download documents from Groupe Mutuel’s platforms on to your own devices, you must ensure the security of the data they contain. Groupe Mutuel declines all responsibility as soon as a document leaves the computer systems of Groupe Mutuel or of one of its service providers.

     
  6. Security
    When becoming aware of a security risk, Groupe Mutuel reserves the right, at any time and without notice, to suspend its platforms. It assumes no responsibility for any resulting damages.

     
  7. Disclaimer of guarantee
    Groupe Mutuel strives to ensure that the information published on its platforms is reliable, accurate and comprehensive. However, Groupe Mutuel does not guarantee the accuracy, comprehensiveness or appropriateness of the said information for any purpose whatsoever. This information is subject to change at any time without notice. The information is made available for information purposes only and should under no circumstances be interpreted as constituting insurance or legal advice or any other form of advice binding Groupe Mutuel. You are advised to seek professional advice before making any insurance-related decisions.

     
  8. Disclaimer of liability
    Subject to the applicable law, Groupe Mutuel, as well as its members, directors, employees, subcontractors and auxiliary personnel, excludes any liability for your losses or damages of any kind whatsoever, in relation to accessing Groupe Mutuel's platforms and using their contents.

    Groupe Mutuel is not liable for any direct or indirect damage caused to you by transmission errors, technical defects, disruptions, breakdowns, network overload, interruptions or any other technical error, subject to gross negligence.

    Nor is Groupe Mutuel liable for any direct and indirect damage resulting from failure of the account user to comply with contractual obligations.

    Under no circumstances shall Groupe Mutuel be held liable for any direct or indirect damage, in particular loss of revenue or damage to reputation.

     
  9. Third party websites
    Groupe Mutuel’s platforms may contain links to other websites monitored or made available by third parties. Groupe Mutuel offers no guarantee with regard to the information or material made available on these websites. By linking a third party’s website to its own platforms, Groupe Mutuel does not assume or accept any liability for the products or services offered through this website.

     
  10. Applicable law and jurisdiction
    The CGU and the use of Groupe Mutuel’s platforms are subject to substantive Swiss law, excluding any principles of conflict of law, subject to binding law. Any dispute relating to Groupe Mutuel's platforms or arising from their use shall be submitted to the exclusive jurisdiction of the competent courts in Martigny, subject to a possible binding jurisdiction.

    This Privacy and Data Usage Policy applies to the processing of data in connection with the website and platforms available at https://www.groupemutuel.ch and all other platforms of Groupe Mutuel Services SA, Rue des Cèdres 5, 1919 Martigny, Switzerland (“Groupe Mutuel”). The use of these platforms is governed by  the general terms and conditions of use  (CGU).

    It applies to the processing of the personal data you have submitted to Groupe Mutuel or that Groupe Mutuel has collected from you through these platforms.

    Groupe Mutuel reserves the right to modify this Policy at any time and without prior notice. In this case, the Policy will be published on the relevant platforms and will cancel and replace the former version. 

    By accessing and using the platforms and entering your data on the platforms, you expressly accept the version of the Policy in force and the processing of your personal data submitted in this way. 

     

  2. Data Processing Regulations
    The principles for the processing of data by Groupe Mutuel are defined in its Data Processing Regulations. The user therefore acknowledges that the Data Processing Regulations of Groupe Mutuel also apply to the platforms and form an integral part of this document.

     
  3. Categories of data collected
    Groupe Mutuel collects data in connection with your access and your use of the platforms. In particular, Groupe Mutuel may collect your personal data through the use of third party services (including Google, Microsoft, Campaign Monitor, Facebook and USafe platforms). Your personal data collected and processed by Groupe Mutuel consists of any information that identifies you or allows you to be identified. This includes the following data: a personal ID number, your first name, last name, address, billing information, email address, IP address, cookies and geolocation data.

     
  4. Security measures
    Groupe Mutuel processes your personal data in compliance with Swiss data protection legislation and takes all the organisational and technical security measures necessary to prevent violation, unauthorised access, disclosure, modification or destruction of your data in general and personal data in particular.

    Groupe Mutuel recommends that you be aware of the potential risk of your data being intercepted and consulted by unauthorised third parties. Groupe Mutuel does not assume responsibility for this risk to the extent permitted by law, subject to gross negligence.

    Chapter 10 provides you with more detailed information on the processing of personal data by authorised third party service providers.

     

  5. Place of processing
    Subject to the provisions of chapter 9 below, your personal data is stored in Switzerland and processed only by Groupe Mutuel companies and their subcontractors. 

     
  6. Retention period & Recipients
    Subject to any legal obligations for storage, personal data is kept by Groupe Mutuel for as long as necessary to fulfil the purposes for which the data was collected.

     
  7. Purpose of processing
    If you are a client of Groupe Mutuel, or if you submit personal data via the platforms in order to become a client, Groupe Mutuel may use the data submitted as part of the establishment and/or management of this contractual relationship. In addition, Groupe Mutuel may use your personal data, in particular contact information and other data submitted via the platforms, for internal analyses and statistics, to improve its products and services and for commercial and advertising purposes to send you information and offers relating to the products and services of Groupe Mutuel and/or its partners, such as leaflets, newsletters and other advertising messages, if you give your consent at the time of submitting such data.

    a. In order to send you information and offers relating to the products and services of Groupe Mutuel and/or its partners, you will find below the contact preferences which apply and which you can adapt at any time via your Customer Area or by completing the contact form.

    Receive news, advice and offers according to my interests:
    Customised offers: I would like to receive proposals for savings on my premiums, as well as information on new products that may be of interest to me.

    Customised services and advice: I would like to receive customised advice to optimise my current contracts, as well as information on new products and services of Groupe Mutuel  (practical tips, news, services linked to the Customer Centre, corporate life, etc.).

    My information magazine:
    Le Mag: I would like to receive the Groupe Mutuel policyholders' magazine.

    My opinion and customer satisfaction:
    Surveys: I agree to be contacted following an interaction with Groupe Mutuel with the aim to improve my customer experience (I will not be contacted systematically).

    My data, processing and sharing:
    Processing and data sharing: I authorise Groupe Mutuel companies and its partners to process my data in order to offer me solutions tailored to my situation.

    Research, care pathways and health system: I authorise Groupe Mutuel companies and its partners to use my data for research and statistical purposes in order to help optimise the Swiss healthcare system.  

    NB : If you have not given your consent to the processing of your data for commercial and advertising purposes, only the data (personal and/or sensitive) that is strictly necessary to fulfil the specific tasks required by law for the type of insurance taken out (e.g. AOS/OKP basic health insurance, LCA/VVG supplemental insurance, etc.), will be collected and processed.    

    b. In order to improve Groupe Mutuel's products and services, as a user of the platforms, you agree that for the purposes of optimising the platforms and for statistical purposes, Groupe Mutuel may, when using the platforms, provide, enter, process and use data anonymously. The data does not allow you to be identified and is simply intended to provide general information on usage behaviour (e.g. frequency of use of the platforms). This data forms the basis for anonymous statistical evaluations and is used to improve the platforms.
     

  8. Updating and accuracy of your data
    If your data (postal or email address, bank account, etc.) changes, you may at any time notify Groupe Mutuel via its platforms or communication channels and request that this data be updated. Groupe Mutuel will take appropriate measures to rectify any data that is inaccurate or incomplete in relation to the purposes for which it is processed.

     
  9. Transfers & Subcontracting
    Groupe Mutuel may transfer your personal data to third party service providers (subcontractors) appointed to support Groupe Mutuel in its activities, in particular in the context of commercial prospecting. Subcontractors may be located and process your personal data in Switzerland or in the European Union.

    Groupe Mutuel may also transfer your personal data to subcontractors located abroad in countries that do not offer a level of protection equivalent to that of Switzerland, in particular the United States. In such a case, you expressly authorise Groupe Mutuel to transfer your personal data to such service providers. Groupe Mutuel will put in place the necessary measures and appropriate guarantees to secure such transfers.

     
  10. Third party provider services

    The processing of personal data by third party service providers is subject to those providers’ own privacy policies.

    a. Access to third party service accounts
    Your access to and use of the platforms may give third party service providers access to your personal data. These features are not activated automatically but require your express authorisation. For example, the platforms may connect and transmit your personal data to social networks such as Facebook, Twitter or LinkedIn, if you use certain features (e.g. social plug-ins). As these social networks use your data, particularly for tracking and advertising purposes, Groupe Mutuel recommends that you consult the social networks’ data usage policies and take measures to increase the confidentiality of your data.

    b. Registration and authentication
    The platforms may allow you to register and/or authenticate to use certain features, using third party services. For example, platforms may allow you to register and/or authenticate via your personal Facebook profile. In this case, personal data is exchanged between Facebook and the platforms concerned. Personal data collected in this way by Groupe Mutuel is processed in accordance with this Policy.

    c. Interactions based on geolocation
    Platforms may collect, use and share your geolocation data to provide you with location-based services. Most browsers and electronic devices provide tools to deactivate this default feature. If you have given your consent, your geolocation data may be tracked by Groupe Mutuel platforms. Groupe Mutuel recommends that you configure your mobile device properly to accept or refuse your geolocation.

    d. Third party web pages
    Platforms may contain links to web pages that are not managed by Groupe Mutuel and have no connection with Groupe Mutuel (hereafter referred to as "third party web pages"). The use of such links is at the user's own risk. Groupe Mutuel is neither competent nor responsible for monitoring or assessing the content of such third party web pages. The contents of third party web pages do not reflect the opinion of Groupe Mutuel. Groupe Mutuel therefore accepts no liability whatsoever for the content of third party web pages, in particular with regard to their accuracy and comprehensiveness.


     
  11. Cookies and other tracking devices
    In order to improve the use and functionalities of the website and platforms, Groupe Mutuel uses different types of "cookies" (strictly necessary, performance, functionality, for targeted advertising and for "social networks") or other cookie analysis tools such as "pixel tags", which may automatically record personal data. 

    “Cookies" are small text files that contain, for example, an ID number and are stored on your electronic device. The information generally does not allow you to be identified directly. Cookies allow Groupe Mutuel to improve customer service and to recognise users who have previously visited our platforms in order to customise the content displayed on the platforms you visit. When you access and use the platforms, a cookie identifies your electronic device. Groupe Mutuel also uses cookies to measure and monitor traffic and use of the platforms and their features. A “pixel tag” serves a similar purpose but does not install files directly on your electronic device. 

    You have the option of not authorising certain types of cookies. To do so, you can configure your Internet browser or electronic device. It should be noted however that some cookies are essential to the operation of the platforms, to their use or to certain of their features which could be altered, restricted or not work if the cookies are blocked (strictly necessary cookies). Groupe Mutuel recommends accepting all cookies and not deleting them in order to improve the user's browsing experience and improve the platforms.

    Some cookies may be inserted by third parties (such as Google). In this case, Groupe Mutuel has no control over the insertion of such cookies by third parties, in particular when you visit their websites. However, Groupe Mutuel may use cookies to recognise you when you visit third party websites and to display advertising for its products and services.

    Some cookies are stored on your electronic device only for the duration of your access and use of the platforms, while others remain for a specific or, more rarely, indefinite period.

  12. Specific provisions
    a. Offer & Premium calculator

    During the initial negotiation phase with Groupe Mutuel, as a matter of principle, the offer and your personal data are not saved in Groupe Mutuel's databases, and only the relevant cookies are retained by your web browser. If you wish, you can save your session at any time and resume it within 30 days. During this period, your data will be stored the Groupe Mutuel databases. Once the 30-day period has elapsed, your data will be automatically deleted if you have not finalised your offer and insurance contract or contacted Groupe Mutuel again. 

    b. Contact form
    Some Groupe Mutuel platforms may offer the possibility to contact Groupe Mutuel by email, via contact forms, a premium calculator, chat or any other telecommunication software.
    The personal data you send to Groupe Mutuel via these platforms is processed by Groupe Mutuel under the terms and conditions set out in this Policy. 

    c. Recruitment platform
    It is also possible for applicants to apply directly to Groupe Mutuel via our recruitment platform. In this case, your application will be examined solely on the basis of your professional qualities in relation to the profiles sought or the position for which you are applying. The different selection stages are documented and guarantee the quality of the recruitment process. Groupe Mutuel will keep you regularly informed of the progress of the procedure and applies principles of non-discrimination as part of its recruitment process.

    For this purpose, your personal data is only accessible to the Groupe Mutuel Human Resources management department and to the employees in charge of your recruitment.

    Information concerning your application must be accurate, true and up-to-date and must not be incomplete, misleading or deceptive. Groupe Mutuel would like to remind you that any inaccurate information may result in the termination of an employment contract. Groupe Mutuel therefore reserves the right to delete your profile and/or attached documents if your application does not correspond to the aims of the job advertisement.

    Your attached documents, the data relating to your professional experience and education, as well as your consent, will be deleted six months after you have submitted your application if it has not led to a job offer. With your consent, Groupe Mutuel will keep your data in its database for longer in order to be able to possibly offer you another job opportunity.
     

  13. The Voice of the Customer Community
    The Voice of the Customer community is a Groupe Mutuel initiative aimed at identifying our customers’ needs and expectations in order to improve our services. As a customer, you will have the opportunity to participate in Groupe Mutuel studies in which you will share your opinion on our various projects, contribute to the development of our products and services and receive a reward for your participation. For each study, a random selection is made according to the criteria sought among the clients who are part of the community. When you are invited to take part in a study and as soon as you inform Groupe Mutuel of your interest, you will receive an overview of the project or topic on which your opinion is needed. Participation in Voice of the Customer activities is entirely voluntary. You can therefore unsubscribe at any time by sending an email to: voiceofcustomer@groupemutuel.ch or by clicking on the link ‘unsubscribe’ in the electronic media sent to you.

    When you register with the Voice of the Customer community, Groupe Mutuel collects the following data so that we can contact you and invite you to surveys, discussion groups or events that can interest you:

    - Contact details (first name, surname, street and No., postcode and town, email, telephone)
    - Gender
    - Date of birth
    - Preferred language for studies
    - Nationality
    - Duration of residence in Switzerland
    - Duration of insurance with Groupe Mutuel
    - Type of insurance taken out with Groupe Mutuel
    - Frequency of use of the Customer Area
    - Relationships with Groupe Mutuel
    - Sector of activity
    - Agreement to the terms and conditions of participation and to this Privacy Policy

    The personal data you make available to us is only processed for the activities related to the Voice of the Customer community. Furthermore, the answers and feedback you provide to Groupe Mutuel in these studies are anonymised before being recorded. If, for a particular study, your answers were not to be anonymised, you would be informed in advance when being invited to participate in the study.

    As part of community management and in order to avoid too frequent contacts, the history of your participation in the various studies is also kept.

    Groupe Mutuel may share your personal data with third-party service providers appointed to support these activities. In such cases, Groupe Mutuel ensures that the third-party service providers meet the same requirements as Groupe Mutuel in terms of data protection and security of information.

     
  14. Your rights
    You have the right to access your personal data, to have it corrected, to have it deleted within the limits of the applicable legal provisions, to limit the processing of your data, to have your data transferred and, lastly, to withdraw your consent to the processing of personal data, subject in particular to the processing necessary for the performance of a contract. You may also contact the competent supervisory authority, although Groupe Mutuel advises you to contact our services beforehand.
